§ 1 Scope
The following Terms and Conditions apply to the legal relationship established through the purchase and/or use of admission tickets ("ticket(s)") from the organizer or from third parties authorized by the organizer ("authorized sales points"), in particular for attending events as well as entry and stay at the venue.
§ 2 Ticket Purchase
2.1 Ticket Purchase
Tickets for the organizer's event are generally only available from the organizer or authorized sales points. The organizer reserves the right to limit the number of tickets available for sale in the context of an event and for the individual customer at its sole discretion, as well as to grant or refuse ticket reductions and/or preferential terms. Should different terms apply at authorized sales points in addition to these Terms and Conditions for the purchase of tickets, these Terms and Conditions shall take precedence in the relationship between the customer and the organizer.
2.2 Online Sales
If a personal password is assigned to the customer in the event of registration in the case of online ticket ordering, the customer is responsible for ensuring that no unauthorized third parties obtain knowledge of their password. The customer is liable for any misuse by third parties in this connection, unless the customer is not responsible for the misuse. In the case of an online order for a ticket, the customer submits a binding offer to conclude a contract with the organizer by using the online command provided for this purpose on the Internet site. The contract between the organizer and customer is concluded on the basis of these Terms and Conditions with the transmission of the ticket.
2.3 Price
The ticket price is determined by the current price list. Orders for tickets are processed only against advance payment and with the accepted payment methods. In addition to the ticket price, the organizer may charge the buyer for shipping costs in the case of ticket dispatch and/or for services in the buyer's interest, a reasonable service fee (for example, advance sale fee).
2.4 Discount
The organizer issues discounted tickets to certain persons and/or groups of persons. The organizer provides information in a timely manner about which persons and/or groups of persons are entitled to a discount. For the respective discount entitlement, the day on which the event takes place for which a ticket is purchased is decisive. The current official discount proof must be presented when purchasing the ticket and must also be carried when entering the venue and shown upon request.
2.5 No Right of Withdrawal and Return
Even if the organizer offers tickets via distance communication means within the meaning of § 312c (2) BGB and thus a distance selling contract may exist according to § 312c (1) BGB, there is no right of withdrawal for the customer when purchasing a ticket according to § 312g (2) No. 9 BGB. This means that a two-week right of withdrawal and return does not exist. Every offer or order for tickets is therefore immediately binding after confirmation by the organizer and obligates you to accept and pay for the ordered tickets. Exchange and refund are generally excluded; the customer's statutory rights and the provisions in § 4 of these Terms and Conditions remain unaffected.
§ 3 Ticket Dispatch, Complaints
3.1 Dispatch
The (electronic) dispatch of the tickets is carried out by the organizer or the authorized sales point. The organizer bears the risk of tickets being lost or damaged during dispatch. Tickets ordered for dispatch are regularly delivered to the customer within three business days from the order. If the customer has not received any tickets by this time, any loss during dispatch must be reported to the organizer immediately at the contact address.
3.2 Complaint
A complaint about tickets and/or ticket orders that have a discernible defect must be made without undue delay, meaning without culpable delay, as a rule within five (5) business days after receipt of the tickets in text form (email is sufficient), by fax, or by mail to the contact address. For tickets and/or ticket orders that are made within the last fourteen (14) business days before the respective event, the complaint must be made without undue delay; in other respects the previous regulation applies accordingly. Defects include in particular impermissible deviations from the order regarding quantity, price, date, event, and event location and/or visible damage to or destruction of the ticket. The postmark of the incoming mail, or the transmission protocol of the fax or email, shall determine compliance with the complaint deadline. In the case of a justified and timely complaint, the organizer shall issue the customer a new ticket free of charge in exchange for transmission of the complained ticket. The complaint regulations explicitly do not apply to tickets lost in accordance with Section 3.1 or to the sending of unsolicited tickets, nor to cases in which the reason for the complaint is demonstrably attributable to negligence on the part of the organizer. The customer's statutory warranty rights remain unaffected.
3.3 Defect
In the event of a technical defect of a ticket or in the event of difficulties in connection with electronic access control, the organizer shall, upon proven identification of the customer, issue a new ticket with the old ticket blocked or enable the old ticket accordingly. Processing fees according to the organizer's price list may be charged for the new issuance, unless the organizer or third parties commissioned by the organizer are demonstrably responsible for the defect.
§ 4 Relocation, Cancellation, and Termination
4.1 Relocation
The organizer reserves the right to relocate the event, parts of the event, and to make program changes. In all cases, tickets acquired for relocated events or event parts retain their validity but entitle the customer to withdraw from the contract for ticket purchase for the affected event or event parts. Withdrawal by the affected customer must be declared in text form (email is sufficient), by fax, or in writing by mail. The affected customers shall receive, upon presentation or transmission of the original ticket, full refund of the total amount paid affected by the relocation (ticket price including any advance sale and service fees). Shipping costs for the return of the ticket shall be borne by the organizer. The final scheduling of an event does not constitute a relocation within the meaning of this regulation and therefore does not entitle the customer to withdraw if the final scheduling had not yet taken place at the time of ticket purchase.
4.2 Cancellation and Spectator Exclusion
In the event of cancellation of the event, the ticket price shall be refunded in full (ticket price including any advance sale, service, and shipping fees) upon presentation of the original ticket within fourteen (14) business days after the date of the event and provision of bank details. For an event that must take place wholly or partly in compliance with the requirements of a competent association or authority with spectators excluded, both the organizer and the affected customer shall be entitled to withdraw from the contract for ticket purchase for the affected event. Withdrawal by the affected customer must be declared in text form (email is sufficient), by fax, or in writing by mail. The affected customers shall receive, upon presentation or transmission of the original ticket, refund of the ticket price paid less any fees incurred.
4.3 Termination and Repetition of the Event
In the event of termination of an event, the customer has no right to refund of the ticket price paid, unless the organizer is responsible for the termination. In the event of a repetition of the event, that is, rescheduling of an already started and then terminated event, the repetition constitutes a new event; the ticket for the original event has no validity for it, unless the organizer expressly indicates that the ticket also has validity for the repetition. In the event of continued validity, the customer may withdraw from the contract (for withdrawal declaration see Section 4.1). The affected customer shall receive refund of the ticket price paid upon presentation or transmission of the ticket to the organizer; service and shipping fees shall not be refunded.
§ 5 Use and Transfer
5.1 Right of Entry
The organizer does not wish to grant admission to the event to everyone, but only to those ticket holders who have acquired tickets as a customer from the organizer or an authorized sales point or in the context of a permitted transfer in accordance with Section 5.4. The right of entry ends upon first leaving the event venue. In the event of ticket purchase in the context of an impermissible transfer in accordance with Section 5.3, there is no right of entry. The organizer reserves the right to deny entry in this case. Claims for recourse against the organizer are excluded in this case. To prove their identity, the customer must carry an official document (for example, a passport or identity card) and present it upon request.
5.2 Transfer Restriction
To prevent violence and crimes in connection with attending the event and to prevent unauthorized ticket transfer, particularly to prevent ticket speculation, it is in the interest of the organizer and the audience to restrict ticket transfer.
5.3 Prohibited Transfer
If the customer has been issued individualized tickets assigned to them, any commercial or business resale of tickets by the customer is prohibited. The customer is specifically prohibited from:
- 5.3.1 Transferring tickets at a price higher than the ticket price paid; a price markup of up to 10% to cover transaction costs incurred is permitted;
- 5.3.2 Selling or transferring tickets to commercial or business resellers and/or ticket dealers;
- 5.3.3 Transferring tickets to persons against whom an event ban (house/stadium ban, etc.) exists, if this fact was known to the customer or should have been known;
- 5.3.4 Using tickets commercially or business-wise without the express prior written consent of the organizer or allowing them to be used, in particular for purposes of advertising, marketing, as a bonus, as a promotional gift, as a prize, or as part of an unauthorized hospitality or travel package.
In the event of one or more violations of the regulations in section 5.3 and/or other prohibited ticket transfers, the organizer is entitled to not deliver the affected tickets to the affected customer, to cancel them, and to refuse the ticket holder entry to the event venue without compensation or to remove them from the event venue.
5.4 Permitted Transfer
A private, non-public transfer of a ticket for non-commercial reasons, in particular in individual cases due to illness or other inability to attend on the part of the customer, is permitted if no case of prohibited transfer as defined in section 5.3 applies and the customer (i) explicitly informs the new ticket holder of the applicability and content of these Terms and Conditions as well as the necessary transfer of information (for example, upon request first and last name) about the new ticket holder to the organizer according to this section, (ii) the new ticket holder agrees to the applicability of these Terms and Conditions between them and the organizer by purchasing and using the ticket, and (iii) the organizer is informed in a timely manner upon request by naming the new ticket holder of the ticket transfer, or the organizer has implicitly declared the transfer to the new ticket holder as permitted. The transfer of the new ticket holder's data takes place on the one hand for the performance of the contracts between them and the organizer and between them and the customer pursuant to Art. 6 para. 1 sentence 1 lit. b) GDPR. On the other hand, this data processing takes place for the protection of the organizer's legitimate interests (refer to section 5.2) pursuant to Art. 6 para. 1 sentence 1 lit. f) GDPR. For the transfer of discounted tickets, these regulations apply with the additional provision that a transfer is only possible if the new ticket holder also meets the corresponding discount requirements.
§ 6 Conduct at the Event Venue
6.1 House Rights
The exercise of house rights is reserved to the organizer or authorized third parties at all times. All orders from the organizer, police, and security personnel before, during, and immediately following an event must be obeyed at all times. The house rules of the respective event venue must be observed.
6.2 Admission
In principle, every customer or ticket holder with a validly acquired right of admission pursuant to section 5.1 is entitled to admission to the event venue. However, admission can be refused or the customer or ticket holder can be removed from the event venue if
- 6.2.1 the customer or ticket holder refuses to submit to a reasonable inspection of their person and/or items carried with them before entering the event venue at the entrance and/or inside by security personnel;
- 6.2.2 the individualization features printed on the tickets (for example, name imprint, seating details, barcode, QR code, serial and/or shopping cart numbers) are tampered with, illegible, and/or damaged, or an access attempt has already been made with the ticket, insofar as this is not the organizer's responsibility, and/or the ticket holder is not personally identical to the customer who was stored in connection with the ticket and marked with individualization features on the ticket, unless there is a case of permitted transfer pursuant to section 5.4;
- 6.2.3 the customer or ticket holder is visibly intoxicated and/or under the influence of drugs;
- 6.2.4 any of the following items are carried or used: glass containers, drones, pyrotechnic objects, torches, weapons, and similar dangerous items.
In the event of justified denial of access, the customer or ticket holder has no claim for compensation. Furthermore, it is prohibited to carry and/or use the following items: racist, xenophobic, and/or right- or left-wing radical propaganda material, political or religious objects of any kind, including banners, signs, symbols, and leaflets, provided there is reason to believe that these will be displayed inappropriately on the event premises. Regardless of items carried, the expression or dissemination of contemptuous of humanity, racist, xenophobic, politically extremist, obscenely offensive, provocatively insulting, and/or left- or right-wing radical slogans as well as corresponding actions throughout the entire event premises area are prohibited.
6.3 Liability
Your stay on the event premises is at your own risk. The organizer and/or its agents shall be liable for damages, regardless of the legal basis, only in cases of intent or gross negligence or – then limited to the foreseeable damage typical of the contract at the time of contract conclusion – in the event of violation of essential contractual obligations. Essential contractual obligations are those whose performance enables proper contract performance, whose violation endangers the achievement of the contract purpose, and on whose compliance you regularly rely. This limitation of liability does not apply to claims for damages due to violation of life, body, or health or based on other legally mandatory liability provisions. There is no liability for stolen or lost items insofar as the organizer bears no fault within the meaning of the preceding regulation.
6.4 Image Recording
Attendance at the event venue for the purpose of media reporting on the event (television, radio, internet, print, photo) is only permitted with the consent of the organizer and in areas specially designated for these purposes. Without the consent of the organizer, it is not permitted to record or collect sounds, photos and/or images, descriptions or results or data of the event, unless this is done exclusively for private, non-commercial use. For reporting on the event as well as for its promotion, the organizer and/or third parties commissioned or authorized by it (for example, press) may independently create image and video recordings pursuant to Art. 6 (1) sentence 1 lit. f) GDPR, which may show the ticket holder as a spectator. These image and video recordings may be processed, exploited, and publicly displayed by the organizer as well as third parties authorized by it pursuant to Art. 6 (1) sentence 1 lit. f) GDPR.
§ 7 Damages
In the event of a culpable breach of these Terms by you, the organizer is entitled, in addition to the other measures and sanctions possible under these Terms and without prejudice to any further claims for damages, to assert the damage actually incurred. Toward consumers within the meaning of § 13 BGB, the agreement of a flat-rate contractual penalty is legally excluded (§ 309 No. 6 BGB); the concrete damage incurred must be proven in these cases. Toward entrepreneurs within the meaning of § 14 BGB, a reasonable contractual penalty may be agreed, the amount of which depends on the severity of the breach and does not exceed the actual damage.
§ 8 Data Protection
Unless otherwise specifically stated within these Terms, the processing of personal data of you and/or the ticket holder takes place on the one hand for the performance of a contract between the organizer and you or between you and the ticket holder pursuant to Art. 6 (1) sentence 1 lit. b) GDPR and on the other hand for the protection of legitimate interests of the organizer pursuant to Art. 6 (1) sentence 1 lit. f) GDPR. § 9 Contact

9.2 The European Commission provides an online dispute resolution (ODR) platform, which you can find at https://ec.europa.eu/consumers/odr. We are not obligated and not willing to participate in dispute resolution proceedings before a consumer dispute settlement body (see § 36 VSBG).
§ 10 Choice of Law / Place of Performance / Jurisdiction
10.1 The mandatory legal provisions of the country in which you habitually reside apply. Otherwise, German law applies. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
10.2 The sole place of performance for delivery, service, and payment is Kiel.
10.3 For all disputes arising from or in connection with these Terms and/or their validity or legal transactions based on these Terms, the place of jurisdiction is Kiel, unless you are a consumer who, at the time of contract conclusion, has your general place of jurisdiction in the Federal Republic of Germany or your domicile or habitual residence in another member state of the European Union. Mandatory statutory provisions, in particular regarding exclusive jurisdictions, remain unaffected.
§ 11 Electricity Use
11.1 The organizer's service is the provision of an electrical connection (230 V). The electricity is generated locally and is therefore susceptible to disruptions and voltage fluctuations.
11.2 It is your responsibility as a customer/participant to bring and connect cables or other connection materials. For camping plots, you must use a cable that is at least 25 m long and suitable for outdoor use.
§ 12 Amendments and Modifications
In the event of a change in market conditions and/or the legal situation and/or ruling case law, the organizer is entitled, for future contracts, to supplement and/or amend these Terms and Conditions and/or the price list with four (4) weeks' notice in advance, insofar as the changes are factually justified and do not unreasonably disadvantage the customer. Ticket purchase agreements already concluded remain unaffected by such changes. The respective changes will be communicated to the customer in writing or – if the customer has agreed to this form of correspondence – by email. The amendments or modifications shall be deemed approved if the customer does not object to them in writing or by email within four (4) weeks of receipt of the changes and/or amendments, provided that the organizer has expressly pointed out this deemed approval fiction as well as the right to object and the deadline when notifying of the change. Any objection by the customer must be directed to the contact address (§ 9).
§ 13 Final Clause
Should individual clauses of these Terms and Conditions be invalid in whole or in part, this does not affect the validity of the remaining clauses or the remaining parts of such clauses. The parties must replace an ineffective provision with a provision that comes closest to the economic purpose of the ineffective provision. The same applies to any gap in these Terms and Conditions.
